ORDER
1. These appeals are filed assailing the order dated 26^^ May, 2017 passed in CS(OS)No.143/2017 and CS(OS)No.144/2017.
2. In view of the fact that the Id. Single Judge has fixed the matters from which these appeals arise for hearing on 3*^^ July, 2017 and the fact that the written statement ofthe appellant was not placed before the Id. Single Judge on the 26^^. of May 2017, despite the order dated 11*^ May, 2017, the Id. counsel for the appellant seeks leave to withdraw these appeals.
3. The parties in FAO(QS)No.185/2017 are husband and wife. Apart from the civil suit from which the present appeal arises, the husband and wife are also in family litigation including divorce, domestic violence and guardianship.
4. The disputes, between the parties in FAO(OS)No.l85/i017 appear to be capable of resolution by recourse to mediation. Mr. Jayant Mehta, Id. counsel for the appellant husband and Mr. Sandeep Sethi, Id. Senior Counsel lor the respondent wife submit that their clients -would have no objection in exploring the possibility of amicable resolution of their disputes by recourse to mediation.
5. In view ofthe above, it is directed as follows:
(i) These appeals as well as applications are dismissed as withdrawn as prayed.
(ii) The parties in FAO(OS)No.185/2017.shall appear before the
Delhi High Gourt Mediation and Conciliation Centre today itselfat Fa6(OS)Nos.185-86/2017 page 2of[3]. 4:30 pm when the matter shall be'assigned to Ms. Sddhna Ramachandran, Id. Mediator for mediation and the date for appearance of the parties before her shall be fixed. (iii), It shall be open for the Id. Mediator to join any other person or party, deemed necessary, for effective and holistic mediation.
(iv) It is directed,that the participation of the parties in the mediation shall be without prejudice to their respective rights and contentions. -
(v) In case, a settlement is reached in the mediation, the same.
