Exemption is allowed subject to all just exceptions.
1. Learned counsel for the petitioner submits that the petitioner had made an application for grant of authorization for a sum of 2017:DHC:3065 Rs.35,43,976.60 under the Incremental Exports Incentivisation Scheme (IEIS).
2. Learned counsel for the petitioner submits that, as against the application for grant of a sum of Rs.35,43,976.60, credit of only Rs.24,09,592/- has been granted. He further submits that, for the balance amount, neither the credit has been granted nor any reason has been communicated as to why the petitioner is not entitled to the same.
3. It is pointed out that Representations have been made to the respondents to release the script for the balance amount, but the same have not been disposed of till date.
4. Issue notice. Notice is accepted by the learned counsel appearing for the respondents. With the consent of the parties, the petition is taken up for hearing.
5. The writ petition is disposed of directing the respondents to dispose of the representations made by the petitioner. In case, the petitioner is found entitled to the grant of the balance amount, the respondent shall issue the script for the same. In case the respondents are of the view that the petitioner is not entitled to the balance amount of Rs.11,34,385/-. The reasons for the same shall be communicated. The entire process shall be completed within a period of eight weeks from today.
