1. Petitioner herein is defending a suit for possession/damages and mesne profits and is aggrieved by order dated 21.10.2024 whereby order under Order XV-A CPC r/w Section 151 CPC has been passed.

2. Learned counsel for respondent has drawn attention of this Court to order dated 02.05.2025 passed by this Court in CM(M) No. 810.2025 which also refers to the same suit and the grievance of the defendant in that case was to the effect that they had moved an application seeking review of the impugned order and their such review application had been deferred. However, while disposing of the aforesaid CM(M) No. 810/2025, this Court directed learned Trial Court to consider the aforesaid review application as expeditiously as possible, preferably, within four weeks.

3. It is now informed that arguments have already been heard and matter is reserved for 28th instant. CM(M) 117/2025 2

4. In view of the above, there would not be any real purpose in keeping the present petition alive. Resultantly, the present petition is disposed of.

5. However, all rights and contentions of the parties are reserved.

6. In case petitioner is aggrieved by the outcome of its review application, needless to say, he would be at liberty to file the petition afresh.

7. It is, however, clarified that present petition has been disposed of in view of the aforesaid order dated 02.05.2025 and shall not be taken as reflection on the merits of the case.
