Neeraj Aggarwal v. State

1. These two bail applications have been moved by the applicants/petitioners Neeraj Aggarwal and Ramesh Chand Aggarwal seeking bail in case FIRNo.34/2012 under Sections 420/406/467/468/120-B \bAILAPPLN. Nos.851/2017c& 854/2017 Page 1of[3] 2017:DHC:8441 I?C, PS EOW. Applicant/petitioner Ramesh Chand Aggarwal is father of applicant/petitioner Neeraj Aggarwal.

2. Status report has been filed by the State confirming the fact that the wife of applicant/petitioner Ramesh Chand Aggarwal (mother of applicant/petitioner Neeraj Aggarwal) is being confined to bed and his daughter (sister of applicant/petitioner Neeraj Aggarwal) is suffering from impairment to the extent of50%. The photographs ofwife and daughter of applicant/petitioner Ramesh Chand Aggarwal have also been placed on record along with the statement ofSh.Ravinder Dutt, aneighbour.

Learned counsel for the applicants/petitioners submit that since the role of applicant/petitioner Neeraj Aggarwal is very limited and he was e£.rlier enlarged on anticipatory bail by this Court for a period of two months, on humanitarian grounds for the time being, applicant/petitioner Neeraj Aggarwal may be enlarged on bail and applicant/petitioner Ramesh Chand Aggarwal will not press the bail application. 4.j In the given circumstances, considering the condition in which the I mother and sister of applicant/petitioner Neeraj Aggarwal are living at present, the applicant/petitioner Neeraj Aggarwal be released on. bail for a period of three months on his furnishing a personal bond in the sum of 00,000 with one surety of the like amount subject to the satisfaction of the concerned Court/link Court, further subject to the condition that the petitionerwill surrender hispassport to the Trial Courtand will not leave the country without the permission of the Trial Court. In case, the petitioner changes his residential address, the same will be informed to the Trial Court by way of an affidavit. BAIL APPLN. Nos.851/2017 &854/2017 Page 2of[3]

The Bail Appl.851/2017 is accordingly allowed to the above effect. 6.; In view ofthe above that the applicant/petitioner Neeraj Aggarwal has been granted mterim bail, the applicant/petitioner Ramesh Chand Aggarwal does not wish to press the Bail Appl. 854/2017. 7J Bail Appl.
