HIGH COURT OF DELHI
W.P.(C) 17117/2024
DSSSB AND ANR. .....Petitioners
Through: Mr. Gaurav Dhingra and Mr. Shashank Singh, Advocates
Through:
HON'BLE MR. JUSTICE MANOJ JAIN
ORDER (ORAL)
25.07.2025 C. HARI SHANKAR, J.
Rev. Pett. 165/2025 and CM 16696/2025 (condonation of delay of
10 days in filing review petition)
JUDGMENT
1. This application seeks review of judgment dated 11 December 2024 to the extent we have granted relief to the respondent, noting the fact that she had not been informed either by SMS or by email that he had been shortlisted, as was required by Advertisement No. 04/2017, pursuant to which the selection had been held.
2. We have also noted the fact that, even in the counter affidavit filed before the Central Administrative Tribunal[1], from whose decision this writ petition emanated, there was no pleading to the effect that the respondent had been informed of her being shortlisted by the SMS or by email.
3. No copy of the SMS or email purportedly sent to the respondent was placed on record either before the Tribunal or even before this Court when the writ petition was argued.
4. At this juncture, especially keeping in mind the fact that in the counter affidavit before the Tribunal, it was not even pleaded that the respondent had been informed about his short-listing by SMS/email, we are not inclined to entertain such a plea by way of a review petition.
5. We may also note, incidentally, that even the document annexed to this writ petition is neither a screenshot of the SMS nor a copy of the email. It is only a print out of an OARS report.
6. The review petitioner has not, therefore, even now produced any copy either of the SMS or the email whereby the respondent had been informed of her being shortlisted.
7. We, therefore, see no reason to review our judgment dated 11 “the Tribunal”, hereinafter December 2024. The review petition is dismissed. Pending applications, if any, also stands disposed of accordingly.
