ORDER n.08.2017
JUDGMENT
1. The petitioner informs that Mr.M.K.Singh against whom there are serious allegations of sexual harassment is no more in the organisation. Page 1 of[3] 2017:DHC:8516 -7
2. Mr.Ajay Digpaul, CGSC had informed on 22.09.2016 that Mr.M.K.Singh has since been placed under suspension by departmental order dated 26.05.2016. He has been directed to vacate the post of CMD, Bridge & Roof Co. (India) Ltd. w.e.f. 04.06.2016. Mr.M.K.Singh has since vacated the post of CMD, Bridge & Roof Co. (India) Ltd. He has field the writ petition before this Court to challenge it.
3. Petitioner further informs that criminal case CR No.3451/2013 under,Sections 354A(iv)/509 IPC lodged by her against M.K.Singh is pending at Kolkata.
4. She further informs that in view of the fact that M.K.Singh is no more in the organisation and her criminal case is pending in the Court at Kolkata, she wishes to withdraw the present writ petition and contempt petition without prejudice keeping all her rights open. She further urges that all her legal options / submissions be kept open. The Court dealing with the criminal case be asked to expedite the trial.
5. Mr.Ajay Digpaul, learned CGSC for respondent No.l has no objection to the liberty prayed for.
6. The legal contentions raised by petitioner in the proceedings shall remain open. The Criminal Court dealing with criminal complaint of the petitioner is requested to expedite the trial. Withdrawal of the present writ petition shall have no impact on the said proceedings. Page 2 of[3]
7. In case the petitioner succeeds in the criminal case, the Trial Court would consider grant of reasonable compensation as per law to the petitioner.
8. The writ petition and contempt petition are dismissed as withdrawn in the above terms.
