5. Transfer is sought of a suit, transferred on enhancement of minimum pecuniary jurisdiction of this Court to District South-East, Saket Courts, New Delhi to District South, Saket Courts, New Delhi, averring that the property subject matter ofthe suit is situated in District South.

6. The. counsel appearing for the petitioner is not aware whether any objection in that regard has been taken by any of the parties or as to what is happening in the suit since transfer from this Court. TR.P.(C.) No.122/2017 page 1 of[2] 2017:DHC:8556 r-

7. Such petitions for transfer of the suit cannot be entertained unless thereis anysubstantive prejudice to any of the parties.

At this stage, Mr. Arun Singh and Mr. Rahul Kumar, counsels for all the four respondents appear and kate that the needibftransfer is on account of another suit between the partie^pendip-g'^fore the Court of Dr. Ajay Gulati Additional District Judge (South), Saket Courts, New Delhi and which islisted next on 26^^ August, 2017.'

In the light of the above, the earlier order is re-called and suit being CS No.513/2001 of the Court of Additional District Judge (South-East) is transferred to the Court of the District Judge (South), Saket Courts, New Delhi who may consider assigning it to the same Court where the other suit is stated to be pending.

12. A copy of this order be forwarded to the Additional District Judge (South-East), Saket Courts, New Delhi before which the suit is presently pending as well as to District Judge (South), Saket Courts, New Delhi with a request to ensure that the file of the suit is transferred before the date of 26^^ August, 2017.

13. The petition is disposed of.
