JUDGMENT
1. Petitioner has approached this Court by way of this petition under Section 482 Code of Criminal Procedure, 1973 for quashing of FIR 239/2013 under Sections 354-A/506IPC registered at PS Lajpat Nagar.
2. Status report has been filed.
3. It is submitted by the learned APP for the State that charge has already been framed against the petitioner under Section 354A IPC by the learned Metropolitan Magistrate on 17th August, 2017.
4. Respondent no.2/complainant is present in the Court and has been duly identified by the IO. She confirms of filing of affidavit dated 9th July, 2017 along with the writ petition.
5. On making a reference before the learned Metropolitan Magistrate, Mahila Courts, Saket, New Delhi, parties appeared before the learned Mediator in 2017:DHC:4591 the Mediation Centre, Saket Courts, New Delhi and the matter was settled between the parties whereby the complainant / respondent no.2 had agreed not to pursue the matter against the petitioner. The complainant / respondent no.2 in the Court states that since the petitioner is remorseful of his conduct and has two minor children, she does not want to pursue the said FIR and proceedings arising therefrom.
6. In the circumstances when the petitioner and the complainant / respondent no.2 have settled the matter amicably, to secure the ends of justice, FIR 239/2013 under Sections 354-A/506 IPC registered at PS Lajpat Nagar and proceedings emanating therefrom are hereby quashed, subject to petitioner depositing cost of Rs.25,000/- with the PM Relief Fund within a week from today and place on record the receipt.
7. Petition stands disposed of.
