JUDGMENT
1. Petitioner seeks quashing of FIR No. 733/2023 of PS Pandav Nagar for offences under Section 363/376/366 IPC and Section 6 of POCSO Act on the ground that the prosecutrix (respondent no. 3) and her father (respondent no. 2) have compromised the disputes with petitioner. The petitioner and respondents no. 2 and 3 are present in Court, identified by IO/SI Rekha Chauhan.
2. I have spoken with respondents no. 2 and 3 in Hindi.
3. It appears that the missing complaint qua respondent no.3 lodged by respondent no. 2 was registered as the impugned FIR and later it was found that respondent no. 3 got married with petitioner. Now, petitioner and respondent no. 3 are living together and also have a daughter aged about one year.
4. Respondents no. 2 and 3 submit that they do not wish to pursue prosecution of the petitioner because now respondent no.3 is well settled and happily living with the petitioner and their daughter.
5. Having spoken with the parties, I am satisfied that it would be interest of justice not to push the parties through trial.
6. Therefore, the petition is allowed and FIR No. 733/2023 of PS Pandav Nagar for offences under Section 363/376/366 IPC and Section 6 of POCSO Act and proceedings arising out of the same are quashed.
