JUDGMENT

1. The relief prayed for in the present petition is for issuing directions to the respondent No. 1/RCS to decide and dispose of the representations dated 13.07.2017 and 21.08.2017 submitted by the petitioner requesting inter alia that the decision taken for conducting the bye-elections for only 4 posts that have fallen vacant in the Managing Committee of the respondent NO. 2/Society be reconsidered and instead, a fresh election be conducted for the entire Managing Committee comprising of 15 members.

Respondent No. 2/Society has filed an affidavit through the Administrator appointed by the office of respondent No. 1/RCS wherein it has been averred that the respondent No. 1/RCS has issued directions to withdraw W.P.(C) 7553/2017 2017:DHC:5191-DB the election agenda notice dated 11.08.2017 whereunder elections to four posts were directed to be conducted on 10.09.2017. Thereafter, four more members of the Managing Committee had tendered their resignation. A detailed report has been submitted by the Administrator to the respondent NO. 1/RCS.

Learned counsel for the respondent No. 1/RCS states on instructions that the impugned election agenda notice dated 11.08.2017, for conducting the elections to four posts in the Managing Committee of the respondent NO. 2/Society has been withdrawn and a fresh notice shall be issued within two weeks from today for holding elections for the entire 15 posts in the Managing Committee of the respondent No. 2/Society.

4. In view of the aforesaid developments, no further orders are required to be passed in the present petition which is accordingly disposed of along with the pending application. HIMA KOHLI, J DEEPA SHARMA, J SEPTEMBER 07, 2017
