JUDGMENT

1. After arguments,these appeals are disposed of as not pressed and compromised whereby thejudgments and decrees in favour ofSh.Om Dutt Sharma passed by the courts below will stand sustained and the appellant Sh. Hern Chand Sharma will vacate the suit property and hand over vacant peaceful possession ofthe suit property to Sh.Oin DuttSharma on or before 31.12.2017. The appellant-Sh.Hem Chand Sharma atthe time of vacating the property will get an amount of Rs.50,000/- from Sh. Om Dutt Sharma as ex gratia payment and in full and final satisfaction ofany rights which the appellant-Sh. Hem Chand Sharma may have in the suit 'property. Sh.Om DuttSharma also'agreesto give upthe decrees passed in his favour with respect to mesne profits payable by the appellant-Sh.Hem Chand Sharmato Sh.Om DuttSharma withrespectto suitpremises.

2. Appeals are accordingly disposed ofas compromised in terms of aforesaid order., Counsel for the appellant will within two weeks from today give details of the bank account ofthe appellant-Sh. Hem Chand Sharma to Sh. Om Dutt Sharma or his counsel so that when payment of Rs.50,000/- has to be made,the same can be deposited directly by Sh.Om DuttSharmainthe accountofthe appellant-Sh.Hem Chand Sharma.
