JUDGMENT
1 By this application legal heirs ofthe petitioner late Shri Anand Prakash seek to be impleaded as parties.
2. Learned counsel for respondent No.2, who is the only objector in the petition, has entered appearance. He states that late Shri Anand Prakash is survived by hiswifeSmt.KantaGupta,daughters Ms.AartiGuptaand sonMr. Vikas Gupta, besides Ms.Pooja Harbhajanka, who have been impleaded as petitionerNos.1(a)to 1(c)exceptMs.PoojaHarbhajanlca.
3. Affidavit ofMs.Pooja Harbhajanka is placed on record who has stated that though she is a legal heir ofthe original petitioner Shri Anand Prakash however,shedoesnotwishto beimpleadedasaparty. Ms.PoojaHarbhajanlva TEST.CAS.35/2016 ^ 2017:DHC:8548 { J II ispresentinCourtandisidentifiedbythelearnedcounsel. Shestatesthats e doesnotwishtobehnpleadedaslegalheiroflateShrlAnandPrakash.
4 InviewofthedeathofthepetitionerShrlAnandPrakash,hislegalhens, thatis,Smt.KantaGupta,Ms.AartiGuptaandMr.VlkasGuptaarehnpleaded aspetitionerNos.1(a)to 1(c)respectively.

2. ApplicationIsalsosupportedbytheaffidavitsofSmt.KantaGupta,Ms. Aartl Gupta and Mr. Vlkas Gupta. As per the application the parties have entered into a settlement and the petitioners do not wish to pursue the above noted petition.

4. Application is allowed, peimitting the petitioner Nos. 1(a)to 1(c) to withdrawthetestamentarycasebeing TestGasNo.35/2016. TFST.CAS.35/2016 In view of the statements of petitioner Nos. 1(a) to 1(c), petition is dismissed as withdrawn.
