Directorate of Adult Education CGHS v. The Registrar Cooperative Society

1. The matter is listed in the category of ‘Directions’ for learned counsel for the respondent/RCS to report instructions.

2. Today, learned counsel for the respondent/RCS hands over a copy of the order dated 15.09.2017, passed by the RCS, appointing Shri Ashish Kumar Deputy Director, DUSIB as the Returning Officer for holding the election of the entire Managing Committee of the petitioner No.1/Society under the DCS Act, 2003 and the Rules and the Byelaws of the Society. A copy of the said order is taken on record with a copy handed over to the learned counsel for the petitioners.

3. Learned counsel for the petitioners states that prior hereto, the respondent/RCS had twice appointed officers to act as Returning Officers for conducting the elections of the petitioner No.1/Society, but both of them had resigned. He states that directions may be issued to the newly W.P.(C) 4032/2017 2017:DHC:5721-DB appointed Returning Officer to conduct the election in the fixed time schedule.

4. Learned counsel for the respondent/RCS assures the Court that the Returning Officer shall conduct the elections at the earliest and declare the results.

5. In view of the order dated 15.09.2017 issued by the RCS, learned counsel for the petitioners states that he may be permitted to withdraw the present petition while reserving the right of the petitioners to approach the Court at a later stage, if the need so arises.

6. The petitioners are directed to extend all the necessary cooperation to the Returning Officer for him to conduct the elections of the Managing Committee of the Society at the earliest, in a peaceful manner.
