1. By this petition under Section 27 of the Arbitration & Conciliation Act, 1996, the petitioner seeks assistance of the court for summoning of the witnesses for recording the evidence of the petitioner. 2017:DHC:5553 OMP (E) 4/2017
2. The petitioner seeks summoning of the Branch Manager, Kotak Mahindra Bank, Branch AGCR Enclave, Karkardooma, Delhi- 110092 to produce and to prove the record pertaining to RTGS KKBKH14119670576 dated 29.04.2014 as reflected in statement of account pertaining to A/c No. 3811131970.
3. Learned Arbitrator by order dated 04.09.2017 has agreed to the summoning of the said witness for 10.10.2017 and 17.10.2017 at 4.00pm at Room No. 8, Third Floor, Delhi International Arbitration Centre, Delhi High Court, New Delhi.
4. In view of the above, the petition is allowed. The registry is directed to issue summons to appear as a witness to the said witness i.e. the Branch Manager, Kotak Mahindra Bank, Branch AGCR Enclave, Karkardooma, Delhi-110092 to appear before Arbitrator on 10.10.2017 and 17.2017 at 4.00 PM at Room No. 8, Third Floor, Delhi International Arbitration Centre to produce and to prove the record pertaining to RTGS KKBKH14119670576 dated 29.04.2014 as reflected in statement of account pertaining to A/c NO. 3811131970.
5. The petition is accordingly disposed of in the above terms.
