JUDGMENT

1. Petitioner is plaintiff before the learned Trial Court and seeks possession and damages.

2. Such suit was filed by her way back in the year 1995.

3. The limited prayer in the present petition is to the effect that the learned Trial Court may be requested to expedite the disposal of the abovesaid suit.

4. The plaintiff has already concluded her final arguments and case is now fixed for final arguments from the side of defendants.

5. The next date before the learned Trial Court is stated to be 27.09.2025.

6. As per order dated 26.05.2025, when a request was made before the learned Trial Court by the plaintiff seeking pre-ponement of date of hearing, such request was declined by the learned Trial Court on account of its heavy board and it was also observed that the Court was busy in disposal of 30-years’ old cases in furtherance of directions of the District Courts CM(M) 1323/2025 2 Management Committee.

7. Obviously, the suit in question is also 30-years’ old and, therefore, it also needs to be given requisite priority.

8. In view of the above, keeping in mind the age of the plaintiff who is 80 years old lady, and also the fact that the suit was instituted way back in the year 1995, the present petition is disposed of with request to learned Trial Court to give utmost priority to the suit in question and to make best endeavour to dispose of the same as expeditiously as possible and preferably within three months from the date it takes up on 27.09.2025.

9. Needless to say, both the sides shall give requisite assistance and co-operation and defendant shall also conclude their final arguments swiftly.
