13.11.2017 By these petitions, petitioner have prayed for quashing of FIR NO. 425/2016 under Sections 354/506/34 IPC registered at police station
Ambedkar Nagar, on the complaint of respondent no.2. Petitiones and
2017:DHC:8082 respondent no.2 are stated to be neighbours. A perusal of FIR shows that a quarrel took place between them on some trivial issue which had led to registration of present FIR against the petitioners. It is submitted that petitioners and respondent no.2 have now settled their disputes amicably.
Respondent no.2 is present in Court along with her counsel and has been identified by SI Sanjay Singh of police station Ambedkar Nagar. She submits that she has settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion, therefore, she is not willing to pursue the present FIR and the same may be quashed.
Keeping in mind that a settlement has been arrived at between the petitioners and respondent no.2 voluntarily and respondent no.2 has no objection in quashing of the FIR, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed, subject to costs of 25,000/- to be deposited by each of the petitioners with the, Bar
Council of Delhi Advocates Welfare Fund within one week. Receipt evidencing deposit of costs be handed over to the Investigating Officer.
Both the petitions are disposed of in the above terms.
