1. Petitioners are defending a suit for declaration and injunction.

2. When an application under Order XXXIX Rules 1 & 2 CPC was listed before learned Trial Court on 29.07.2025, while taking up the abovesaid application and after hearing both the parties, learned Trial Court has directed both the parties to maintain status quo till next date of hearing.

3. Such order is under challenge.

4. Present petition has been filed under Article 227 of Constitution of India and supervisory Court does not interject if there is equally efficacious remedy available to any such petitioner.

5. The present order is clearly appealable one in terms of Order XLIII Rule 1(r) of CPC and, therefore, the present petition is disposed of while CM(M) 1463/2025 2 granting liberty to petitioners to file appropriate appeal before the competent court of jurisdiction.

6. All rights and contentions of parties are left open.

7. Pending applications also stand disposed of in aforesaid terms.

8. A copy of this order be given dasti under the signatures of the Court Master.
