15.01.2018 The petitioner Ram Kumar is the father-in-law ofthe deceased
Kirti. Aman is the brother-in-law of the deceased. The FIR had been
2018:DHC:9000 registered on the statement of the brother of the victim. The contents of the FIR have been perused. An unfortunate incident i.e, the death of the sister of the complainant had occurred on the intervening night of 10-11/10/2017. This was in her matrimonial home. Her post mortem report has been perused. Two injuries were noted upon her person; on the occipital region and 1X1 cm bruise on her left ear lobe.
The visra report is yet awaited. The cause of death is yet to be finally determined. The statement of the parents of the victim was recorded on 11.10.2017 by the SDM. Learned counsel for the petitioner points out that in this statement the only role attributed is to the husband of the victim namely Vikas; no role has been attributed to either of the two petitioners. The contents of that statement have been perused.
This Court notes that a detailed order had been passed on 06.12.2017 qua the role of the brother-in-law (Aman) who had been granted anticipatory protection till today. The brother-in-law (Aman) has joined investigation. He will continue to join investigation as and when called by the SDM.
Learned counsel for the petitioner Ram Kumar points out that
Ram Kumar is a mechanic in the DTC. He was on night duty on that date and this has been reflected in the statement of the mother-in-law of the victim which has also been recorded before the SDM on
11.10.2017. The case of the petitioners is that they have two houses and the victim and her husband were living in house No. 293, Village
Neelwal, Delhi but the petitioners were living in house adjacent to that house. This submission had been noted in the order dated
06.12.2017. In the course of investigation it has been revealed that there were two houses which belonged to the family and as per the learned APP, (under instructions of the investigating officer,) it has been informed that one house was being used to keep the buffaloes of their family but the other house was the residence of the parties. The fact that Ram Kumar was not present even at the hospital at the time when thepolice party reached the hospital is admitted. Submission of the petitioner being that he was on nightduty at thatpoint.
Without delving into further facts in the matter, this Court is of the view that noting the allegations in the FIR as also the statement of theparents ofthe victim which are largely bordered against the role of
Vikas (husband of the victim) and on the undertaking of the petitioners that they will join the investigation as and when summoned by the investigating officer, in the event of arrest, petitioners be admitted to bail on the furnishing of the personal bond inthe sum Rs 10,000/- with one surety ofthe like apount.
