JUDGMENT

1. Prayer clause in this writ petition reads thus: “In view of facts and circumstances stated above, it is most respectfully prayed that this Hon'ble Court be pleased to:-

(i) Issue writ of mandamus directing the respondent

No.5 to decide the representations dated 15.12.2023 made by petitioner particularly on the aspect of resignation from service by which the petitioner can take better treatment for his injury on his back and knees while on duty with National Disaster Response Force.

(ii) Conduct a COURT OF INQUIRY about the on duty injury on back and left knee of the petitioner and about the allegations made by the petitioner in representation dated 15/12/2023 at ITBP HQ Level.

(iii) To direct the respondents to grant the post

W.P.(C) 11947/2025 retirement benefit, along with all consequential benefits and with the arrears & interest @12% per Anum w.e.f. the date of discontinuation, viz 01.04.2024.

(iv) Pass any such other orders as it may deem fit to this

2. Learned Counsel for the respondents’ points out that first prayer in this petition is infructuous as the representation dated 15 December 2023 stands rejected by order dated 5 November 2024. No challenge has been made to the said order.

3. Accordingly, we dispose of this petition reserving liberty with the petitioner to challenge the order dated 5 November 2024, if so advised, in accordance with law.
