2018:DHC:9320 (a) FIR No. 263/2012 under Sections 308/323/34 IPC registered at P.S.
Frash Bajar on the complaint of Mr. Manjeet Singh Sachdeva, respondent no. 2/complainant in Crl. M.C. No. 4153/2017 and petitioner no. 1/accused in Crl.M.C. No. 4156/2017;
(b) FIR No. 264/2012 under Sections 323/341/34 IPC registered at P.S.
Frash Bazar on the complaint of Mr. Harish Kataria, respondent NO. 3/complainant in Crl. M.C. No.4156/2017 and petitioner no. 2/accused in
Crl. M.C. No. 4153/2017;
It, is pointed out that during the investigation Section 3(i)(x) of the
The Scheduled Castes and Tribes (Prevention ofAtrocities) Act, 1989 was added. It is submitted that complainants and accused in both the cross FIRs have settled their disputes amicably, vide a Compromise Deed dated 22"^^
August, 2017 oftheir own free will and without any undue force, pressure or coercion and have no objection in case the aforesaid cross FIRs are quashed.
Petitioners/complainants/victims are present in Court along with their respective counsels and have identified by SI Avaneesh Singh of Police
Station Farsh Bazar, as well as they have identified their signatures on the
Compromise Deed.
Keeping in view that a quarrel took place between the parties on some trivial issues, which led to registration of the aforesaid cross FIRs and now they have settled their disputes amicably, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest ofjustice, FIR No. 263/2012 under Sections 308/323/34 IPC and
FIR No. 264/2012 under Sections 323/341/34 IPC both registered at P.S.
Frash Bazar and the consequent proceedings emanating therefrom are quashed, in view ofthe settlement.
Both the petitions are disposed ofin the above terms. Dasti.
