JUDGMENT

1. Petitioner seeks release of arrears of Selection Grade by asserting that the Selection Grade stands granted to him in pursuance of Departmental Promotion Committee’s meeting of 23rd September, 2016, with effect from 1st January, 1998.

2. Attention of this Court is drawn to order of 20th February, 2017 passed in CONT.CAS.(C) 54/2017 titled Shahid Ahmad Ansari v. Punya Sahiy Srivastava & Ors., filed by petitioner. Vide aforesaid order, Contempt Petition has been disposed of as infructuous as respondent- School has already intimated respondent-Directorate of Education vide letter of 28th January, 2017 as reproduced in the order of 20th February, 2017, to fix petitioner’s pay in Selection Scale; to finalize the arrears and to communicate it to petitioner. 2018:DHC:615 W.P.(C) 7657/2017

3. Learned counsel for petitioner submits that the arrears of Selection Grade have not been granted to petitioner. No Representation has been made to respondent-Directorate of Education to seek the relief as sought in this petition.

4. In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with permission to petitioner to make a Representation to respondent-Directorate of Education within a period of two weeks from today and upon receiving such a Representation, respondent-Directorate of Education shall pass a speaking order thereon within a period of six weeks thereafter and its fate be made known to petitioner within a week thereafter, so that petitioner may avail of the remedies as available in law, if need be.

5. With the aforesaid directions, this petition is disposed of. Dasti.
