JUDGMENT
1. Mr. Pulkit Kapoor, learned counsel for respondents/complainants, in all the above matters, appears on advance notice.
2. The grievance in the present matter is with respect to the manner in which the learned District Consumer Disputes Redressal Commission (hereinafter referred to as ‘District Commission’) has issued NBWs against the petitioners herein in EA No. 73/2024, EA No. 83/2024, EA No. 82/2024, EA No. 72/2024 and EA No. 63/2024.
3. Learned counsel for respondents/complainants, without prejudice to his rights and contentions, submits that he would have no objection if the warrants are re-called with the condition that the petitioners would be duly represented through counsel before the learned District Commission on the next date of hearing, which is stated to be 22.08.2025 and continue to abide by the further directions given by learned Commission.
4. Without going into further details, and in view of the abovesaid statement made by the learned counsel for respondents, the coercive process i.e. issuance of NBWs in all the abovesaid matters against the two petitioners CM(M) 1515/2025 & other connected matters 4 herein, is re-called with the direction that both the petitioners would remain duly represented through counsel before the learned Executing Commission on the next date of hearing and on any subsequent date(s) given in said petitions.
5. All the rights and contentions of the parties are reserved.
6. Needless to emphasize, if Executing Commission feels any requirement of issuing coercive process, it would be at liberty to pass any such order in accordance with law, albeit, would also supply requisite reasons thereof.
7. This Court also expects that the application, if any, moved by the petitioners herein is also taken up and disposed of, in accordance with law, after giving due opportunity of hearing to both the sides.
8. The present petitions stand disposed of.
9. Pending applications also stand disposed of in aforesaid terms.
10. A copy of this Order be given dasti under the signatures of Court Master.
