16.02.2018 These are two cross FIRs. The petitioners are seeking quashing of the said proceedings. FIR No.0374/2017 has been registered on the complaint of Ms. 'K' under Sections 354/342/323 read with
2018:DHC:8687 t Section 34 of the IPC at Police Station Hauz Khas qua the incident dated 22.10.2017. The second FIR i.e. FIR No.0375/2017 of even date registered at the same Police Station was under the provisions of
Sections 452/323/34 of the IPC and this was on the complaint of Ms. 'HT'. All the parties are present in person. It is stated that the parties have settled their disputes. The presence of the complainant and the accused persons has been identified by the respective Investigating
Officers who are present in Court. In terms of the settlement, it is stated that the parties have no dispute left against one another. All the parties are in fact closely related except Kavita who is the friend of
Yashika, one ofthe petitioners in W.P.(Crl.) No.479/2018. In terms of the aforenoted settlement, the parties do not wish to press these complaints any further. The complaints are yet under investigation and charge-sheet has not yet been filed. It would be an exercise in futility to continue with the proceedings in view of the aforenoted narration of facts.
Accordingly, to secure the ends of justice, FIR No.0374/2017 registered under Sections 354/342/323 read with Section 34 of the
IPC and FIR No.0375/2017 registered under Sections 452/323/34 of the IPC at Police Station Hauz Khas and all proceedings emanating thereto are quashed.
