JUDGMENT

1. In this petition, mandamus is sought to respondents 1 and 3 to consider petitioner for appointment on the post of Assistant Hydrographic Surveyor. Petitioner claims to be eligible and the only candidate who had applied in response to advertisement of 4th October, 2016. Learned counsel for petitioner submits that the said post is still lying vacant and petitioner had made an e-mail representation (Annexure A-8) to 2018:DHC:1015 W.P.(C) 1217/2018 respondent Nos.[1] to 3 on 4th November, 2017. It is submitted that no response to this representation has been received.

2. In the facts and circumstances of this case, this petition is disposed of with permission to petitioner to file a concise representation to third respondent within a period of one week and if such a representation is received then third respondent shall pass a speaking order thereon within a period of four weeks and the fate of the representation be conveyed to petitioner within a week thereafter so that petitioner may avail of the remedies as available in law, if need be. It is made clear that before the unreserved post of Assistant Hydrographic Surveyour is filled in pursuance to advertisement (Annexure A-2) the fate of the petitioner’s representation be conveyed to him.

3. With aforesaid directions this petition and the application are disposed of.
