14.03.2018 When the appeals are taken up for hearing, counsel for the respondent has raised an objection based upon circular F.
No.390/Misc./163/2010-JC/PT-III of the Central Board of Excise and
Customs read with instruction dated l?"' December, 2015, fixing the monetary limit for appeal before the Tribunal, High Court or the
Supreme Court. It is stated that in each appeals, the quantum of duty, fine and penalty imposed is Rs.2 laldis or below. ;
By the instruction dated 1?"^ December, 2015, monetary limit for filing appeals before the High Court was fixed at Rs.l5 lakhs.
It. is accepted by the counsel for the appellant that the total amount of duty, fine and penalty involved in each appeal is below
Rs.l5 lakhs, even if we go by the figures mentioned in the order-in-
2018:DHC:9220-DB original.
In these circumstances, we are not inclined to examine and decide the present appeals on merits. However, for the purpose of record, theywould betreated as,disposed of.
