This matter has been taken up upon urgent mentioning as per the directions ofHon'ble the Acting ChiefJustice.
' Issue notice. Ms.Anita Sahani,learned counsel for the respondent, who appears on advance notice submits that the petitioner has been suspended from the hostel only in view of the various allegations levelled by a number ofstudents regarding,his invplvement in a ruckus created by some students in the hostel in night preceding 'Holi'. She further submits that in order to have a fair enquiry the respondent have decided notto permitthe petitionerto continue to stay in the hostel as his presence in the hostel is likely to affectfair investigation.
2018:DHC:8575 0^ Learned counsel for the respondent, on instructions, submits that the enquiryinto theincident will be positively completed within 10days, afterfollowing due process as perrules.
Keeping in view the categoric, statement made on behalf of.the respondents that the enquiry would be completed within ten days, this
Court is not inclined to interfere with the impugned order.However,the
■ petitioner is granted time till6 p.m on 15.03.2018 to vacate the hostel.It is however made clear that in case the respondent does not pass any order based on the enquiry within 10 days,the petitioner will be entitled to rejoin the hostel on 25.03.2018.
The petition is accordingly disposed of alongwith all the applications in the above terms.
