05.03.2018 2018:DHC:8380 Petitioners and private respondents have prayed for quashing of two cross' FIRs, that is, FIR No.468/2013 under sections
323/341/506/509/34 IPC and FIR No.469/2013 under sections
323/341/506/34 IPC, both registered at police station Dwarka South, in view
, of the settlement arrived at between them before the Division
Bench on 22nd April, 2016 in FAO (OS) -341/2015 titled as "Ms
Sushma Singh & Anr. Vs. Ms Poonam Singh" & CS (OS) 225/2013
'titled as "Sushma Singh & Mr. Vs. Ms Poonam Singh".
Mr. Vir Vijay Singh and Ms. ,Poonam Singh were party to the said civil litigations. Mr. Rameshwar Singh, petitioner no.1 in Cr1
Misc. Main 204/2017 was not a party to the said civil suit and
FAO(OS), however, he was present in the Court before the Division
Bench on 22nd April, 2016 and gave his consent for quashing of the
FIRs. Relevant para no.15 of the order dated 22nd April, 2016 passed by the Division Bench in the aforesaid matters reads as under:-
"We also record consent of the parties that they will cooperaEe
• with each other for quashing all cross FIRs-registered inter-se the
• 4 parties and shall withdraw any other civil proceedings initiated inter-se the parties. 'We also record consent of Shri Rameshwar
Singh father. of appellant no.] and the respondent that he and his
• wife will cQoperate in quashing of such criminal proceedings which they have initiated against the appellants."
In view of the settlement arrived at between the petitioners and private

' respondents, I am of the view that no fruitful purpose would be served by keeping criminal proceedings pending. Accordingly, both the aforenoted FIRs, that is, FIR No.468/2013 'under sections
323/341/5061509/34 IPC and FIR No.469/2013 under sections
323/341/506/34 IPC, both registered at police station Dwarka South and consequent proceedihgs emanating therefrom, are quashed.
Petitions are disposed of in above terms Dasti.
