1. By these petitions petitioners Sanjay Kumar-Mittal and Shaileiidra Nath Nath in Bail Appl. No.2041/2017 and Paritpsh Mittal in Bail Appl. No.2093/2017 seek anticipatory bail in case FIR No, 299/2017 under,* ■ Sections 325/452/506/34 IPC registered atPS Hauz Khas.
2. The above noted FIR was registered after a PGR call was received on 28 August,.2017 at PS Hauz Khas which.was recorded vide DD No. 15A informing regardipg a quarrel at P-45, Panchsheel Enclaye, near SBI Bank bailAPPLN. 2041/2017and2093/2017 Page 1 of[2] O 2018:DHC:8182 New Delhi.. On reaching the spot the Investigating Officer found that a quarrel had taken place between Sanjay Kumar Mittal,Parltosh Mittal and their Chartered Accountant Shailendra Nath with their partner/Director Vinod Kumar Sharma when they were attending the EGM as there were somefinancialdisputesoftheirreaiestatecompanies. Inthescuffleinjuries were received by Vinod Kumar Sh^a on whose complaint, the above noted FIR was registered who alieged thatthe three petitioners trespassed, intimidated him and caused grievous injury. As per the x-ray report of Vinod Kumar Sharma,the doctor opined thathe had suffered fracture base ofphalanx oflittle fingerleft.
3. Considering the nature of injuries and that on the complaint of petitioners across-FIR wasregistered onthe quarrel whichtook place and thatthe petitioners havejoined the investigation this Court deems it fit to grantanticipatory bailtothe petitioners.
4. It is,therefore, directed that in the event ofarrest the petitioners be released on bailontheirfurnishing a personalbondinthesum of?25,000/each with one surety ofthe like amount each subjectto the satisfaction of the Arresting Officer/SHO concerned,further subject to the condition that the petitioners will join the investigation as and when directed by the InvestigatingOfficerand willnotleavethecountry withoutpriorpermission ofthe Courtconcerned and in case ofchange ofresidentialaddressthesame willbeintimatedtothe Courtconcernedby wayofan affidavit.
