ORDER

1. The petitioners, in CRL.M.C. 1209/2018 seek quashing of FIR No. 12 of 2013 under Sections 147/148/149/323/427 of the IPC Police Station, Roop Nagar, New Delhi and Petitioners in CRL.M.C. CRL.M.C. 1209/2018 & 625/2017 Page 1 2018:DHC:8382 625/2017 seek quashing of FIR No. 13 of 2013 under Sections 147/148/149/323/427/34 of the IPC Police Station Roop Nagar, New Delhi, based on a settlement.

2. The parties are neighbours and the subject cross FIRs were registered consequent to an altercation that took place between the parties. The parties have settled the disputes and a settlement agreement has been recorded on 26.11.2016 before Delhi Mediation Centre, Tis Hazari Courts, Delhi and further a compromise deed has been executed on 08.02.2017. - 3. Both the. parties are present in person in Court today, represented by their respective counsels and are identified by the.4^ ' Investigating Officer. They submit that they have settled their all disputes with the intervention of locals and respectable people of the locality. They further submit that they do not wish to press the criminal complaints against each other any further.

In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility andjustice in the case demands that the dispute between the / parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

5. In view of the above, the petitions are allowed. FIR No. 12 of 2013 under Sections 147/148/149/323/427 of the IPC Police Station CRL.M.C. 1209/2018 & 625/2017 Page 2 Roop Nagar, New Delhi and FIR No. 13 of 2013 under Sections 147/148/149/323/427/34 of the IPG Police Station Roop Nagar, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed, subject to each set of petitioners in the two cases jointly depositing cost of Rs.18,000/- with the "Prisoners Welfare Fund, Jail No. 13, Mandoli", Mangal Pandey Marg, Harsh Vihar, Village Mandoli, Delhi within three weeks. The receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of four weeks from today.
