JUDGMENT

1. Petitioners had sought benefit of promotion while calling upon second respondent to recognize the academic degrees obtained by them. The Representation made by petitioners stands rejected vide impugned order of 20th May, 2016 (Annexure P-1). Learned counsel for respondent- TPDDL relies upon Supreme Court’s decision in Orissa Lift Irrigation Corporation Limited v. Rabi Sankar Patro and Others, (2018) 1 SCC 468 to seek rejection of this petition.

2. Learned counsel for petitioners submits that second respondent be called upon to consider petitioners’ case for promotion in light of the decision in Rabi Sankar Patro (supra) and Supreme Court’s clarificatory order of this decision. 2018:DHC:1730 W.P.(C) 6420/2016

In the facts and circumstances of this case, this petition is disposed of with liberty to petitioners to make a fresh concise Representation in light of the decision in Rabi Sankar Patro (supra) and its clarificatory order. Learned counsel for petitioners submits that fresh Representation will be made within a period of four weeks from today. If such a Representation is received by second respondent, then it be accordingly dealt with within a period of twelve weeks in light of decision/clarificatory order rendered by Supreme Court in Rabi Sankar Patro (Supra) and the fate of the Representation be made known to petitioners within two weeks thereafter, so that they may avail of the remedies as available in law, if need be.

4. With aforesaid directions, this petition is disposed of.
