1. The Petitioners seek anticipatory bail in FIR No.138/2017 under Sections 323/341/506/34/308 IPC, Police Station Hauz Khas.
2. Subject FIR was registered consequent to a quarrel between the parties over their children. Cross-FIR being FIR No.140/2017 under Sections 323/341/506/34 IPC has also been registered against the complainants in the subject FIR.
3. Learned counsels for the parties submit that the parties have settled their disputes where under it has been agreed that the petitioners shall pay a sum of Rs.[1] lakh to the complainants in the subject FIR within a period of two weeks.
4. Though the parties have reconciled their disputes, they have agreed that the petitioners will tender their apology to the complainants before the respectable elder members of the Society, who have mediated between the parties, because of which, settlement between the parties have been arrived at.
5. It has been agreed that both the parties shall respectively initiate BAIL APPLN. 871/2017,942/2017, 979/2017 & 982/2017 Page 3 appropriate proceedings for quashing of FIR No.138/2017 and compounding of the offences/quashing in FIR No.140/2017.
6. Petitioners in Bail Application No.871/2017 were granted interim protection on 11.05.2017. Petitioners in Bail Application No.942/2017 were granted interim protection on 19.05.2017. Petitioners in Bail Application No.979/2017 were granted interim protection on 25.05.2017 and Petitioners in Bail Application No.982/2017 were granted interim protection on 25.05.2017.
7. The Investigating Officer submits that the petitioners joined investigation, as and when were called upon to do so.
8. Since the parties have settled their disputes and petitioners have complied with the orders granting interim protection, I am of the view that the petitioners have made out the case for grant of anticipatory bail.
9. In the event of arrest, the Arresting Officer shall release the petitioners on bail on furnishing a personal bond in the sum of Rs.25,000/by each of the petitioners.
10. The Petitions are disposed of in the above terms.
