ORDER
1. The petitioners in Crl. M.C. 4908/2017 seek quashing of FIR No.332/2013 under Sections 323/341/506/34 IPC, PoHce Station CRL.M.C. 4908/2017 & Page 1 2018:DHC:8386 Shakarpur. The petitioners in Crl. M.C.4909/2017 seek quashing of FIRNo.371/2013 under Sections 354/504/506/34 IPC, Police Station Shakarpur. The subject FIRs are cross-FIRs.
2. It is contended that the parties are neighbours and the subject FIRs have been registered consequent to a quarrel that took place over parking ofvehicles.
3. Learned counsel for the petitioners submits that both the parties have settled their disputes and a Memorandum of Understanding dated 17.09.2017 has beenexecuted between the parties.
4. Parties are present in person, represented by respective counsel and identified by the Investigating Officer. They submit that, they have settled all their disputes. They further submit that they do not wish to press their respective complaints.
5. In view of the fact that disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimateguiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.
6. In view of the above, the petitions are allowed. FIR No.332/2013 under Sections 323/341/506/34 IPC, PoHce Station Shakarpur and FIRNo.371/2013 under Sections 354/504/506/34 IPC, CRLMC. 4908/2017 & Page[2] CRLMC. 4909/2017 Police Station Shakarpur and the consequent proceedings emanating therefrom are accordingly quashed.
