JUDGMENT
07.05.2018 SANJEEV SACHDEVA, J. (ORAL)

1. The petitioner seeks anticipatory bail in FIR No.34/2017 under Section 420/ 34 IPC, Police station Krishna Nagar.

2. As per the subject FIR, a total sum of Rs.12,00,000/- was received by the petitioner. On 06.04.2018, statement of the complainant was recorded that he was willing to settle the entire dispute with the petitioner on petitioner paying a sum of 2018:DHC:2975 Rs.12,00,000/- along with the interest of Rs. 1,50,000/-.

3. A sum of Rs. 8,00,000/- was paid on the last date i.e. 06.04.2018. Further sum of Rs. 4,00,000/- was to be paid on or before 21.04.2018. It is confirmed by the parties that the said amount of Rs. 4,00,000/- was paid in terms of the order dated 06.04.2018. Further sum of Rs.1,50,000/-, representing the interest component has been paid to Mr. Sarwan Singh/complainant, who is present in Court in person, towards full and final settlements of all claims of the complainant. The said amount has been paid in cash.

4. The said amount of Rs.12,00,000/- and Rs.1,50,000/- has been paid to Mr. Sarwan Singh/complainant, which is acknowledged in Court today.

5. The complainant further submits that the petitioner has filed a complaint case against Mr. Sarwan Singh/the complaint for recovery of Rs. 40,000/-.

6. It is also agreed between the parties that they shall be filing appropriate petitions seeking quashing of the subject FIR as well as for quashing of the complaint case filed by the petitioner against respondent No.2.

7. In the event of the arrest, the petitioner shall be released on bail by the Arresting Officer/SHO/IO on petitioner furnishing a personal bond in the sum of Rs. 25,000/- to the satisfaction of the Arresting Officer/Investigating Officer/SHO.

8. The petition is disposed of in above terms.
