1. The petitioner seeks anticipatory bail in FIR No. 1355 of 2014 under Section 376 of the IPC, Police Station Begum Pur, Delhi.
2. The allegations against the petitioner are that the petitioner who is a property dealer had called the prosecutrix to his offence for the purpose of getting her a job and thereafter forcefully made physical relations.
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated and it is a case of implication in a false case and there was demand made by the complainant for money and also that she has 2018:DHC:2967 BAIL APPLN. 899/2018 instigated by one Junior Engineer of MCD, against whom a complaint was made by the Petitioner. It is contended that the petitioner has been trapped in a false case.
4. It is observed that the chargesheet has been filed without arrest in this case after investigation.
5. Learned Addl. PP informs that the matter is listed before the Metropolitan Magistrate on 09.05.2018 for the purpose of committal proceedings.
6. Learned counsel for the petitioner submits that in case the proceedings are committed to the court of Sessions, the petitioner is likely to be arrested and there may be delay in taking up the application of the petitioner for grant of regular bail.
7. In view of the above and keep in view the facts and circumstances, it is directed that no coercive action shall be taken against the petitioner till the time application of the petitioner for grant of regular bail is taken upon by the concerned court. This is subject to the petitioner moving an application seeking regular bail on the next date of hearing.
8. The petition is disposed of in the above terms.
