JUDGMENT
CM No.40264/2017 The application is allowed and the appeal is taken up for hearing today itself.
1. The appellant is seeking enhancement of the compensation in respect of the agricultural land situated in village Bakkarwala acquired vide award No.1/DCW/2006-2007 dated 11th August, 2006.
2. Learned counsel for the appellant submits that the other land owners of villages Mundka and Bakkarwala filed the appeals which were decided by this Court vide judgment dated 8th July, 2011 in the case titled Jamna v. 2018:DHC:3105 Union of India, LA.APP.784/2005 and the other connected appeals. Learned counsel for the appellant further submits that the aforesaid judgment has attained finality as the Special Leave Petition has been dismissed by the Supreme Court. Learned counsel seeks enhancement of compensation in terms of the judgment dated 8th July, 2011 in Jamna v. Union of India.
3. Learned counsel for the Government confirms that the judgment dated 8th July, 2011 in Jamna v. Union of India, LA.APP.784/2005 has attained finality and this appeal can be disposed of in terms of the judgment dated 8th July, 2011.
4. Following the judgment of this Court in LA.APP.784/2005 titled Jamna v. Union of India decided on 8th July, 2011, this appeal is allowed and the compensation to the appellant is enhanced to Rs.4,98,589 per bigha i.e. Rs.23,93,227.20 per acre as on 17th June, 2005 in terms of para 33(iv) of the judgment dated 8th July, 2011.
