1 Petitioner upon the death of his father, who was working as a Gardener with the second respondent, had sought appointment on compassionate ground. Petitioner’s mother had made a Representation on 19.06.2010 seeking compassionate appointment of petitioner. Learned counsel for petitioner submits that petitioner was granted compassionate appointment on the post of Gardener on daily wages and on the said post, petitioner had worked for about one and a half years. It is submitted that service of all daily wagers were discontinued with effect from 23.12.2011. Petitioner claims to have obtained RTI information in the year 2016 and thereafter had approached the National Commission for Scheduled Castes. It is the case of petitioner that after obtaining the RTI information etc., Representation was made to second 2018:DHC:2814 W.P.(C) 4565/2018 respondent. He had approached the second respondent to seek compassionate appointment by pointing out that the ban of filling up the Group D post which is outsourced, would not apply to a case of compassionate appointment.

2 Learned counsel for petitioner submits that a concise Representation would be made afresh to second respondent to seek compassionate appointment while relying upon the RTI information within a period of four weeks. If any such Representation is received by the second respondent, then it be effectively dealt with in the light of RTI information etc. provided by petitioner, within a period of six weeks. In case, the petitioner is not to be granted compassionate appointment then the reasons be spelt out in the order by second respondent and be promptly conveyed to petitioner to enable him to have in recourse to law, if need be.

3 Second respondent be apprised of this order forthwith to ensure its compliance.

4 With aforesaid directions, this petition is disposed of. Copy of this order be given dasti to learned counsel for both the parties.
