JUDGMENT
1. Petitioner is judgment debtor and after hearing arguments, submits that as per instructions, the entire balance decretal amount would be paid on or before 31.01.2026. As a gesture thereof, a sum of Rs. 5,00,000/- shall be deposited within two days, before the learned Execution Court.
2. He, however, submits that in view of the above, the auction of the property in question be kept in abeyance.
3. The impugned order would reflect that the learned Trial Court, in order to realize the decretal amount, has directed one property to be attached and to be sold by way of auction.
4. Such property is situated at Model Town, Delhi and its reserve price has been settled as Rs.1,13,85,283/-.
5. The matter has been fixed before the learned Executing Court on CM(M) 1491/2025 2 12.12.2025 for submitting final report of the auction.
6. Learned counsel for respondent appears through video-conferencing on advance notice and submits that he would have no objection if the present petition is disposed of with the direction to judgment debtor to clear the entire balance decretal amount on or before 31.01.2026.
7. In view of the above, the present petition is disposed of in aforesaid terms and, resultantly, judgment debtor is granted time till 31.01.2026 to clear the entire payment balance decretal amount.
8. Such payment would be made by him in a phased manner and a sum of Rs. 5,00,000/- be deposited paid within two days. The detailed terms and conditions with respect to balance payment be placed before the learned Executing Court on 13.08.2025.
9. The impugned order, whereby there is direction to attach the property and to put it on sale, is accordingly kept in abeyance till date 30.01.2026.
10. The present petition is disposed of in aforesaid terms.
11. Pending applications also stand disposed of.
