1. Petitioner seeks anticipatory bail in FIR No.1832/2015 under Sections 308/323/34 IPC, PS Mangolpuri.

2. The allegations against the petitioner are that there was an altercation outside the house of the complainant which started with verbal abuse and subsequently led to fight. It is alleged that the nephew of the complainant was caught hold of by one of the accused and the other co-accused inflicted injuries with a knife and a chopper. It is alleged that three persons sustained injuries. 2018:DHC:2887

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated and there are cross-FIRs registered. He further submits that, as per medical report, the nature of injuries is simple. He further submits that the alleged incident is of the year 2015 and there is no recovery of any weapon.

4. The petitioner was granted interim protection by order dated 08.08.2017 subject to joining investigation. There is no complaint by the Investigating Officer that the petitioner has failed to join investigation, as and when so required.

5. Without commenting upon the merits of the case, I am of the view that the petitioner has made out a case for grant of anticipatory bail. In the event of arrest of the petitioner, the Arresting Officer/Investigating Officer/SHO shall release the petitioner on bail subject to the petitioner furnishing a bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO. The petitioner shall not do anything, which shall prejudice either the investigation or any of the prosecution witnesses. The petitioner shall join investigation, as and when so required by the Investigating Officer.
