JUDGMENT

1. Consequent upon a Departmental Inquiry, penalty of removal from service was inflicted upon petitioner vide order of 9th June, 2016 (Annexure P-1) against which petitioner has filed a statutory Appeal (Annexure P-3) on 26th October, 2017.

2. Learned counsel for petitioner submits that the said appeal (Annexure P-3) has not been decided till date.

3. Despite service of advance notice, there is no Representation on behalf of second and third respondent.

4. In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with direction to the Appellate Authority to 2018:DHC:3419 W.P.(C) 5560/2018 effectively consider petitioner’s appeal (Annexure P-3) by way of a speaking order and it be decided within a period of six weeks, if not already done and the fate of the appeal be made known to petitioner within a week thereafter, so that petitioner may avail of the remedy as available in law, if need be.

5. Third respondent be apprised of this order forthwith, to ensure its compliance.

6. With the aforesaid directions, this petition is disposed of. Copy of this order be given dasti to petitioner’s counsel.
