JUDGMENT

1. Allowed,subjecttojustexceptions. W.P.rCI No.5714/2018& CM Anpl.No.22177/201S

2. Via this writ petition, the petitioner/EDMC has challenged summons dated 27.4.2018 issued by the National Human Rights Commission. By virtue of the impugned summons, the Commissioner of the petitioner Coi-poration has been directed to make himself available on 29.5.2018 at ■ 1L00A.M.

3. It appears that this situation came about as terminal benefits of respondent No.l had not been paid. 3.[1] It is the stand ofthe petitioner Corporation that the terminal benefits, which included pension and amounts to be paid towards DGRC,though W.P.(C)No.5714/2018 Pg.lof[2] \i 2018:DHC:8749 sanctioned, could not be remitted to respondentNo.l on accountofpaucity offunds. In my view, nointerference is called for with theimpugned summons dated 27.4.2018. The Commissionershould be abie to explainthesituation obtaining in the matter to the NHRC.

5. Writpetition is,accordingly,dismissed. W.P.fC)No.5714/2018 may25,2018/pmc RAJIVSHAKDHER,J Pg-2 of[2]
