JUDGMENT

1. Allowed, subject to just exceptions. W.P.(C) No.5661/2018

2. Issue notice. 2.[1] Mr. Srivastava accepts notice for the respondent.

3. In view of the order that I propose to pass, Mr. Srivastava does not wish to file a counter in the matter.

4. The limited relief that the petitioner seeks is the registration of Gift Deed dated 24.10.2017 executed by the petitioner in favour of his son i.e., the petitioner No.2. The averments made inthe writ petition suggest that the subject property was sought to be acquired by the State at one stage. The W.P.(C) No.5661/2018 Pgj of[2] 2018:DHC:8751 acquisition proceedings, according to the petitiorier, have come to an end and therefore, the subject property isnow available for transfer.

According to the petitioners, the acquisition proceedings terminated with the dismissal ofthe Special Leave Petition on 28.4.2016, 5.[1] It is the petitioners' assertion that pursuant to the said proceedings coming to an end, on 10.4.2017, qua subject property, the subject Gift Deed was executed by the petitioner No.l infavour ofrespondent No.2.

6. Mr. Srivastava, who, appears on advance notice on behalf of the respondent says that the respondent sought to know the status of the property since 27.10.2017. The impugned notice, according to Mr. Srivastava, only reiterated what was stated vide deficiency memo dated 27.10.2017.

7. Having regard to the assertions made in the writ petition, the writ petition is disposed of with a direction to the respondent to treat this writ petition as arepresentation and deal with the sanie qua the request made by petitioner No.l for registration ofthe subject Gift Deed.

8. Needless to say that petitioner No.l will provide certified copies of relevant court orders to the respondent. In case" ftirther information is required, the registering authority will be free to establish contact with the concerned official i.e., ADM.

9. Consequently, the pending application will stand closed.
