Exemption is allowed subject to all just exceptions.
1. The petitioner seeks Regular Bail in FIR No.72/2018 under Sections 308/34 IPC, Police Station Moti Nagar. 2018:DHC:3242
2. The allegations against the petitioner are that the petitioner along with co-accused assaulted the complainant and his friends, on account of which, they sustained injuries.
3. Learned counsel for the petitioner submits that the subject FIR is cross-FIR to an FIR lodged by the petitioner. He submits that the petitioner has been falsely implicated as it was the complainant and his friends who had inflicted gunshot wound on the petitioner and had attempted to kill the petitioner and his friends and there were two country-made pistol used by the complainant and his friends. He submits that the FIR No.71/2018 under Sections 307/34 IPC read with Sections 25/27 of the Arms Act has been registered against the complainant qua the said incident which is of the same date and time. He submits that injuries were sustained by the complainant because he was subsequently over powered by public and beaten.
4. Without commenting upon the merits of the case, perusal of the case shows that the petitioner has made out a case for grant of regular bail. Petitioner has been in custody since 12.03.2018.
5. In view of the above, the petitioner shall be released on bail, if not required in any other proceedings, subject to the petitioner furnishing a bail bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Trial Court. The petitioner shall not do anything which may prejudice either the Trial or the prosecution witnesses.
6. The petition is disposed of in the above terms.
