JUDGMENT
1. Petitioners upon retirement had taken employer’s contribution to CPF under protest, with an undertaking to refund it and had applied for grant of GPF/pension.
2. Learned counsel for petitioners submits that vide Representation of 17th May, 2014, switch-over from CPF to GPF-cum-Pension Scheme was sought by petitioners, but there is no response to the said Representation, despite Reminders of 8th September, 2016 and 27th December, 2016 and the decision of a Division Bench of this Court in Shashi Kiran and Ors. vs. Union of India and Ors.(Annexure P-9). 2018:DHC:3580 W.P.(C) 5970/2018
3. Upon hearing, I find that no effective Representation has been made by petitioners in light of decision in Shashi Kiran (supra). In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition and the application with permission to petitioners to make fresh concise Representations to Registrar of respondent-University within a period of two weeks from today. If any such Representations are received by respondent-University, then it be considered by the Competent Authority of respondent-University in light of decision in Shashi Kiran (supra) within a period of six weeks, by giving a speaking response thereto, and the fate of said Representations be conveyed to petitioners within two weeks thereafter, so that petitioners may avail of the remedies as available in law, if need be.
4. With aforesaid directions, this petition and the application are disposed of. Copy of this order be given dasti to counsel for the parties.
