JUDGMENT

1. Respondent-Directorate of Education, vide order of 3rd January, 2013 (Annexure P-12) had directed respondent-School to pay remuneration to petitioner from July, 2003 till the date of termination.

2. Learned counsel for petitioner submits that despite best efforts of petitioner, order (Annexure P-12) has not been complied with by respondent-School. It is pointed out by petitioner’s counsel that petitioner had made Representations (Annexures P-17 & P-18) to respondent- Directorate of Education on 21st April, 2016 and 30th May, 2016 respectively to seek compliance of said order of 3rd January, 2013 (Annexure P-12), but till date, there is no response to these Representations by respondent-Directorate of Education.

3. In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with permission to petitioner to make a precise Representation to respondent-School within a week from today to seek 2018:DHC:3302 W.P.(C) 5374/2018 compliance of order of 3rd January, 2013 (Annexure P-12). If such a Representation is received, then respondent-School shall pass a speaking order thereon, within a period of six weeks and convey its fate to petitioner within two weeks thereafter, so that petitioner may avail of the remedies as available in law, if need be. Let respondent-Directorate of Education also give a speaking response to petitioner’s Representations (Annexures P-17 & 18), within six weeks from today, if not already done.

4. Respondent-School be apprised of this order forthwith, to ensure its compliance.

5. With aforesaid directions, this petition and the application are disposed of. Copy of this order be given dasti to counsel for the parties.
