Vide Office Order of 27th March, 2018 (Annexure P-1) provisional pension has been sanctioned in favour of petitioner. Not satisfied with the quantum of provisional pension, Representations followed by legal notice of 22nd March, 2018 (Annexure P-6) was served by petitioner upon first respondent. According to petitioner’s counsel, there is no response to the Representation/legal notice.
Despite service of advance notice, there is no Representation on behalf of the respondents.
In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with a direction to first respondent to consider the legal notice/(Annexure P-6) as Representation and to give a speaking response to it, within a period of six weeks and the fate of said legal

W.P.(C) 5435/2018 notice/Representation be made known to petitioner within a week thereafter, so that petitioner may avail of the remedies, as available in law, if need be.
First respondent be apprised of this order forthwith, to ensure its compliance.
