02.07.2018 ' During the course of hearing, counsel for the appellant has
•stated that they would be moving an application before the single
Judge stating that the appellants are ready and willing to comply with the Neeti Aayog Circular, but are unable to do so as the respondent is not ready and willing to comply with the conditions and stipiilations mentioned therein. -
Learned senior counsel appearing for the respondent states that the Neeti Aayog Circular would not be applicable in the present case for various reasons. He submits that in case an application is filed, they would file reply and argue the matter before the single Judge.
Appellant has stated that they would be filed an application before the single Judge within 10, days from today.. We also record
2018:DHC:9176-DB the concession made by the counsel for the respondent that they would not press for compliance ofthe order dated'28'^ May, 2018, if an application is filed before the single Judge within 10 days.
On an application being filed, the single Judge would consider the request ofthe appellant for appropriate orders regarding and on the question of deposit of money etc. Counsel for the parties also state that they would be pressing for early disposal of the. said application.
Recording the aforesaid statements, the appeal is disposed of without making any comments on merits.
