1. Petitioner seeks quashing of FIR No.158/2017 under Sections 354/354A/354D of the IPC at Police Station Paharganj. Parties are residing in the same residential Railways colony.
2. Subject FIR was registered consequent to a complaint filed by the complainant that petitioner had misbehaved with her while she was going in the lift.
3. Learned counsels for the parties submit that the parties have 2018:DHC:4300 CRL.M.C.3289/2018 settled their disputes with the intervention of respectable persons and members of the society. Settlement Agreement dated 04.06.2018 has been executed.
4. Respondent No.2 is present in Court in person and identified by the Investigating Officer. She submits that she has settled the dispute with the petitioner and does not wish to press the complaint.
5. In view of the fact that the disputes between the petitioner and respondent No.2 have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating there from.
6. In view of the above, the petitions are allowed. FIR No.158/2017 under Sections 354/354A/354D of the IPC at Police Station Paharganj, New Delhi and the consequent proceedings emanating there from are, accordingly quashed.
7. Order Dasti under signatures of the Court Master.
