JUDGMENT

1. On the oral prayer of petitioners, co-accused as well as victims 2018:DHC:4035 are added as petitioners and respondents, respectively. Amended memo of parties is taken on record.
2. The petitioners, in Crl. M.C. 3309/2018 seeks quashing of FIR No. 72/2018 under Sections 341/323/34 of the IPC at Police Station Jaffarpur Kalan, Dwarka, New Delhi and petitioners, in Crl. M.C. 3326/2018 seeks quashing of FIR No. 71/2018 under Sections 341/323/506/509/34 of the IPC at Police Station Jaffarpur Kalan, Dwarka, New Delhi, based on a settlement.
3. The subject FIRs are cross FIRs registered consequent to a quarrel that took place between the parties who are neighbours.
4. Learned counsels for the parties submit that parties have settled their disputes with the intervention of respectable people of the society and senior family members. Deed of Settlement dated 30.05.2018 has been executed.
5. Both the parties are present in court in person, represented by their counsels and identified by the Investigating Officers. They submit that they have settled their disputes with each other and they further undertake that they shall maintain peace and harmony in the locality and shall not fight with other in future. They submit that they are agreeable to the settlement and do not wish to press the criminal charges against each other any further.
6. In view of the fact that the disputes between the petitioners and respondents have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIRs and the consequent proceedings emanating there from.
7. In view of the above, the petitions are allowed. FIR NO. 72/2018 under Sections 341/323/34 of the IPC at Police Station Jaffarpur Kalan, Dwarka, New Delhi FIR No. 71/2018 under Sections 341/323/506/509/34 of the IPC at Police Station Jaffarpur Kalan, Dwarka, New Delhi and the consequent proceedings there from are, accordingly quashed.
8. Order Dasti under signatures of the Court Master.
