16.07.2018 The petitioners seek anticipatory bail as they are apprehending their arrest in connection with FIR No. 79/2014 dated 31.01.2014 under sections-
2018:DHC:8223 363/370/374 of the Indian.Penal Code 1860 and sections 75/79 Juvenile
Justice Act, 2015 registered at Police Station JahangirPuri. - ' t
The complainant has sought an outstanding amount of Rs.1.8 lacs from the petitioners along with the proprietor of the firm-Mr.Sanjay Kumar f . '
,Singh, the petitioners are ready and willing to settle the lis and all claims apropos complainant and the victimby payingan amountof Rs.3 lacs.
The complainant is presentwith her motherand has been identified by the Investigating Officer. A Demand Draft.bearing No.037865 for the sum of Rs.3 lacs dated 12.07.2018 drawn on HDFC Bank has been handed over to her today in the court through the proprietor of the entity which had engaged her for,domestic services.'
In the circumstances, a ,case is made out by the petitioners for grant of interim protection.
Consequently, it is directed that in the eventof arrest of the petiticmers in FIR No. 79/2014 dated 31.01.2014 under sections 363/370/374 of the
Indian Penal Code 1860 and sections 75/79 Juvenile Justice Act, 2015 they be released on bail on their furnishing a personal bond in the sum of
Rs.25,000/- with a surety each in the like amount to the satisfaction of the
Arresting/Investigating Officer, subject to.the following conditions:
(i) the petitioners shall continue to participate the investigation .as and when he is so intimated by the Investigating Officer; .
(ii) they shall make no attempt, directly or indirectly, to contact'the complainantor her relatives or close associates; • - '
(iii) .They shall furnish his mobile phone number to the SHO concerned, which shall be kept operational at all times, so that the police could contact them;
- (iv) they shall not make any effort to evade the process oflaw; and
(v) in case of change of the phone numbers or address, the petitioners shall inform the police forthwith.
Any observation made in this order shall have no bearing on the merits of the case... . •
The bail applications are disposed off.
