23.07.2018 Mr. Sood, the learned Senior Advocate for the petitioners submits that over sixty six complaints have been filed with the police beginning
September, 2017; nearly ten months have gone by and not a single FIR has been registered. The petitioner's case in WP(Crl.) 2028/2018 is that she had shares worth over Rs 4 crores in her name but one fine morning she found that they had vanished from her Demat account, without any intimation or instructions from her to dispose-offthe shares. Upon inquiry from the share trading company, she got no satisfactory response, hence a complaint was
2018:DHC:9111 made in November, 2017. Herrepeated follow-up, bothwith the trader and the police, have yielded no result.
Mr. Sood submits that the other petitioners too have a similar grievance and the petitioners are now informed that shares worth approximately Rs. 400 crores are thesubject matter ofthefraudulent activity of the broker but despite the enormity of the crime, depriving hundreds of innocent investors oftheir hard-earned monies, none oftheperpetrators have been arrested by the police till date.
Mr Lao, the learned Standing Counsel for the State refers to the Status
Report filed by the Asstt. Commissioner of Police, Economic Offences
Wing (EOW) on 21.07.2018 to contend that since the allegations pertained to transactions carried out all over the entire country spread over different banks and financial institutions and other juristic entities, the gathering of information is taking some time; nevertheless, a special team comprising of one ACP, one Inspector and two Sub-Inspector has been constituted. Mr. Lao states upon instructions from the DC?, BOW, who is present in Court, that looking into the large footprint of the alleged crime and the intricate web of financial transactions, the number of Sub-Inspectors shall be augmented froin two to four.
Mr. Lao further submits that a FIR has been registered apropos the aforesaid complaints and a Look-Out Circular has been opened against all the accused. He assures the Court that investigations are underway in right earnest, to meticulously gather all information and to arrive at a comprehensive and fair report at the earliest. He further submits that the
Economic Offences Wing (EOW) of Delhi Police is cognizant of the importance of the matter and the grievance of a large number of citizens.
2018:DHC:9111 and the resultant deprivation of their rightful monies, therefore, the case is being monitored by Mr. Haider Ali, DCP-II, EOW.
At this stage, Mr. Sood expresses anxiety of the petitioners as what they perceive to be the slow pace of the investigation and the fact that
-nobody has been arrested till date. These fears are allayed by the learned counsel for the State, who submits that appropriate steps will be promptly taken by the police as the investigation progresses and the situation so demands.
In view of the above, no ftirther orders are required at this stage.
Should the petitioners have any grievance about the progress of investigation or lack thereof, it would be open to them to move an appropriate application before the Chief Metropolitan Magistrate (North-
West) to monitor the case.
The learned counsel for the UOI, as above mentioned, state that erroneously their appearance was not recorded on the previous date.
The petitions are disposed off accordingly.
